ARTICLE 1 - PURPOSE
The companý IXTEM MOTO SAS (hereinafter the "Organizing Company"), with a capital of 16,108 euros, registered with the RCS of Pontoise under the number 490712858 whose registered office is located 427 route de Conflans - 95220 HERBAY represented by Michel DAS NEVES in his capacity as Chairman, organizes from 08/12/2023 from 00h01, to 03/06/2024, 23h59, a game with obligation of purchase entitled "Win the T7 of IXTEM MOTO" (hereafter the "Game"), only accessible on its website:

The terms and conditions of participation in the Game and the procedures for selecting the Winners are described in these rules (hereinafter referred to as "the Rules").
ARTICLE 2 - GAME DATES
The contest runs from 08/12/2023 at 00:01 am to 03/06/2024 at 11:59 pm. The draw will take place on Tuesday 18 June 2024 and will be conducted by SPE SAS FRADIN TRONEL SASSARD et ASSOCIES, Commissaires de justice associés.
ARTICLE 3 - ACCESS TO THE GAME
The Game is open to all natural persons of legal age who have Internet access and a personal electronic address (email) at which they may be contacted for the purposes of managing the Game (hereinafter the "Participant"), with the exception of members of staff of the Game's organizing bodies, and any person directly or indirectly involved in its organization or execution, as well as their spouse (marriage, PACS, cohabitation) and members of their family: ascendants and descendants in the direct line.
Only entries complying with all the stipulations of the present article will be considered. The Société́ Organizing Company reserves the right to carry out any verification it deems useful, in particular concerning the identity, age and address of each participant, with a view to complying with the stipulations of the present article. The Organizing Body reserves the right to ask any Participant to provide proof of these conditions. Any information provided in the registration form that is incomplete, erroneous, falsified or that does not make it possible to identify a participant or his/her contact details will result in the cancellation of his/her participation.
Participation in the Game is exclusively by Internet, to the exclusion of any other means, including by post.
Participation in the Game implies express and unreserved acceptance of the present rules in their entirety, of the rules of ethics in force on the Internet (etiquette, charter of good conduct, etc.), and of the laws and regulations applicable to contests in force in France.
The Game is not sponsored, managed, sponsored or organized by Facebook or Instagram. Subsequently, any comments, questions or complaints regarding the Game must be addressed to the Organizing Company and not to Facebook or Instagram. The information communicated by participants is provided to the Organizing Company and not to Facebook or Instagram.
ARTICLE 4 - PARTICIPATION IN THE GAME
Participation in the game is exclusively via the https://ixtem-moto.com/ website.
As such, the Participant must have an Internet connection and an e-mail address enabling the Organizing Body to communicate with the Participant. Entries may not be made by telephone, fax, post, e-mail or any other means other than those set out in this article.
To play, the Participant must, between 08/12/2023 at 00:01 and 03/06/2024 at 23:59:

2. Purchase the T-Shirt shown on this page at the unit price of €35 (incl. VAT + postage where applicable), choosing the size and quantity required (1 T-Shirt = 1 contest entry).

Only Participants who have correctly followed these steps will have their application validated and will be automatically entered into the prize draw.
It is specified́ to the participants:
- That any retraction and/or request for reimbursement will result in the cancellation of participation in the Game (request only possible under the legal retraction period in force of 14 days after the date of purchase). Furthermore, the Organizing Company cannot be held responsible for any postal delays beyond its control. The extension of the withdrawal period provided for in the pack+ does not apply to the "Win the IXTEM MOTO T7" T-shirt.
The request will be made via the email address: clients@ixtem-moto.com or the return form available to the customer on his account.
The return of the merchandise will be at the participant's expense. Upon receipt and validation of the new condition of the T-Shirt(s), we will proceed with the reimbursement (after deduction of shipping costs, if applicable).
Any request for reimbursement of the purchase of the T-Shirt(s) via the https://ixtem-moto.com/website or directly to our head office in Herblay will cancel participation in the game.
In the event of an unresolved dispute in favour of the Organizing Company and/or non-payment in full for the T-Shirt, participation in the Game will be cancelled and the T-Shirt will revert to the property of the Organizing Company.

ARTICLE 5 - DETERMINING THE WINNER
The draw will take place on Tuesday June 18, 2024, from among all complete entries (as described in article 4).
The draw for the winner and 3 alternates (for a total of 4 drawn, 1 winner and 3 alternates) will be carried out by SPE SAS FRADIN TRONEL SASSARD et ASSOCIES, Commissaires de justice associés, 79 bis Cr Vitton, 69006 Lyon.
After being notified by e-mail by the organizing company, the winner will have 10 days to confirm his/her win by e-mail only.
Any prize not claimed by the winner within this 10-day period will be considered lost and will be awarded to a substitute drawn at random.
The substitute, after having been notified by e-mail by the Organizing Company, will have 10 days to come forward and confirm his/her win by e-mail only.
If necessary, new alternates will be drawn at random until the prize is awarded.
ARTICLE 6 - THE PRIZE

The prize awarded may not be contested by the winner.
In the event of force majeure, or if circumstances so require, the organizing Société́ reserves the right to replace the prize won with a prize of equivalent or greater value.
ARTICLE 7 - INFORMING THE WINNER
Winners will be notified of their win directly by the game's Organizing Company exclusively by email within ten (10) days of the draw.
It is reminded that a participant is identified by the contact details he/she provided when registering. In the event of a dispute, only the Organizing Company's participant listings will be deemed authentic.
Any incomplete or inaccurate contact details will be considered invalid and will not entitle the Winner designated by random draw to receive his/her prize. In general, entries to the Game will be cancelled if they are incomplete, erroneous, counterfeit or made in a manner that contravenes the present rules.
The winner authorizes the Organizing Company to publish his/her name on the Internet or in any other medium it deems appropriate. The winner's name will be posted on the site after the draw.
The winner accepts that the presentation of the prize be filmed and broadcast on social networks, the Internet, TV and all media communication supports.
ARTICLE 8 - DELIVERY OF THE PRIZE
The keys to the motorcycle must be handed over in person in Herblay (95) on the date agreed between the winner and the organizing company. Once the winner has identified himself/herself, he/she must collect his/her prize within a maximum of 20 days.
Transportation of the winner and the motorcycle will be at the winner's expense.
ARTICLE 9 - MODIFICATION OF THE GAME AND THE RULES
The Société́ Organizer reserves the right to postpone, extend or shorten the Game, as well as to modify all or part of the conditions of access and/or the terms of implementation of the Game, if circumstances oblige it to do so without having to justify this decision and without its responsibilitý can be engaged in any way as a result. Any modification to the rules will be announced on the operation's publication page and will come into force as soon as it is put online.Any Participant will then be deemed to have accepted this modification simply by taking part in the Game from the date of entry into force of the said modification.
A new filing will be made with the law firm FRADIN TRONEL SASSARD et ASSOCIES.
ARTICLE 10 - PRIVACY - INFORMATION TECHNOLOGY AND CIVIL LIBERTIES
The personal data collected in the entry form are compulsory. It is intended exclusively for the organizing Société́, for the sole purpose of taking into account participation in the game, managing the winner and his alternates, awarding prizes and to meet legal and regulatory obligations. They may be communicated to service providers and subcontractors that the organizing Société́ may call upon for the purposes of organizing and/or managing the Game.
In accordance with the amended law no. 78-17 of January 6, 1978 relating to information technology, files and freedoms (known as the "Loi informatique et Libertés"), all Participants have the right to access, rectify, delete and oppose data concerning them by simple written request sent to the game's e-mail address: contact@dustgarage.com. Should a Participant exercise his/her right to delete his/her personal data, his/her participation in the Game will be cancelled.
ARTICLE 11 - LIMITATION OF LIABILITY
The responsibilitý of the organizing Société́ is strictly limited to the delivery of the prizes effectively and validly won.
It is expressly reminded́ that internet is not a secure network. The organizing Société́ cannot therefore be held responsible for contamination by any viruses or intrusion by a third party into the system of the terminal of participants in the Game and decline all responsibilitý for the consequences of participants' connection to the network via the site: https://ixtem-moto.com/
More specifically, the Organizing Company may not be held liable for any damage caused to participants, their computer equipment and the data stored therein, as well as any consequences that may arise on their personal or professional activitý.
The Organizing Company disclaims all liability in the event of malfunction of the internet network, telephone lines, reception equipment preventing the proper running of the Game.
The Organizing Company shall not be held liable in the event that one or more participants are unable to connect to the https://ixtem-moto.com/site or to play due to any technical problem or fault related in particular to network congestion. The Organizing Company may cancel all or part of the game if it appears that fraud has occurred in any form whatsoever, including computer fraud in connection with participation in the game or the determination of the winner. In such a case, the Organizing Company reserves the right not to award the prize to the fraudsters and/or to prosecute the perpetrators before the competent courts.
The Organizing Company cannot be held responsible for the loss of any postal or electronic mail and, more generally, for the loss of any data.
The organizing Société́ will make every effort to allow access to the game on https://ixtem-moto.com/ at any time, without however being bound to any obligation to achieve this. The organizing Société́ may, at any time, notably for technical, updating or maintenance reasons, interrupt access to https://ixtem-moto.com/ and to the game it contains.
The organizing Société́ will in no way be held responsible for interruptions and their consequences, for the content of the services consulted on Instagram, Facebook or any other support sites and mobile applications and, in general, for any information and/or data disseminated on the services consulted.
The organizing Société́ cannot be held responsible for any incident and/or accident that may occur during the enjoyment of the prize awarded and/or due to their inappropriate use by the winner.
It is specified́ for all purposes that the organizing Société́ will not provide any service or guarantee related to the use of the endowment making up the prize, these consisting solely of the delivery of the endowment provided for the game.
ARTICLE 12 - APPLICABLE LAW AND JURISDICTION
These rules are governed by French law. Participants are therefore subject to French regulations applicable to contests.
In the event of any dispute or claim, for any reason whatsoever, requests must be sent in writing to the e-mail address clients@ixtem-moto.com to the Organizing Companý within two (2) months after the close of the Game.
Any dispute arising in connection with this Game and which cannot be settled́ amicably will be submitted to the competent courts.
ARTICLE 13 - FILING OF THE RULES
The rules have been filed with the law firm FRADIN TRONEL SASSARD et ASSOCIES Commissaires de Justice in LYON.
